Who has the authority to authorise an abandoned car removal from private land?
The simple answer is – The Police & a Local Authority (however, we can complete this for you using the Torts Interference with Good Act 1977). Normally, an abandoned vehicle is classed as such, if at least one or more of the following apply to it:
- There are no keepers details held at DVLA, which would also suggest it is untaxed. We can check this for you online.
- It has been stationary, in the same place, for an extended period of time.
- There is significant damage to the vehicle, making it unroadworthy.
- Burned out.
- One, or more, of it’s number plates appear to be missing.
- The abandoned vehicle contains waste/rubbish.
- the abandoned vehicle appears to be of very little value.
What is the procedure for car removal from private land?
- One of our agents would attend where the abandoned car/vehicles are situated & attach Torts Notices, this would then be photographed as evidence of doing so.
- Our agent would take photographs of the car/vehicles in general, this is to head off any possible allegations of damage caused by us, or the property owner at the time of service.
What happens after the Torts Notices are placed on the car/vehicles?
- We would run the car/vehicles details through our extensive database, this is to see if they have any outstanding Warrants or Writs relating to them.
- We would check to see it the car/vehicles are currently taxed.
- We would check to see if the car/vehicles have current insurance.
- We would conduct checks to see if the car/vehicles are wanted by any finance companies, or are reported as stolen.
- We would try to ascertain the current value of the abandoned car/vehicles.
What happens if the car/vehicles are still on my property when the Torts Notice run out?
- We would arrange for new Torts Notices to be drawn up. These would inform the last known keepers of the car/vehicles, that they are about to be disposed of.
- The new Torts Notices would then be hand delivered to the last known keepers address/es of the car/vehicles, as per our DVLA checks, a Statement of Service would then be prepared, outlining such delivery.
- Once that Torts Notice runs out, we would then liaise with the property owner on the best way to dispose of the vehicle.
